Terms
Terms
These terms explain how to order websites and support from H1ky Websites, how payments work, and what your rights are.
§ 1 Who I am
- The services are provided by Bohdan Demchuk, ul. Powstańców Warszawy 5/98, 22-100 Chełm, Polska, NIP 5632466310 (VAT-UE PL5632466310), REGON 544661571, registered in the Polish business register (CEIDG), the “Provider”.
- Contact: email marketing@h1ky.com.
- Words used in these terms:
- “Client”: a person who orders a service.
- “Consumer”: a natural person who orders a service not directly related to their business or profession.
- “Sole trader with consumer rights”: a natural person running a one-person business for whom the contract has no professional character (based on their CEIDG entry). They have the same rights as a Consumer under § 7, § 8 and § 9.
- “Site”: the website built for the Client.
- “Package”: Start, Standard or Pro, as described in the “Packages” section of the H1ky Websites site.
- “Order confirmation”: an email from the Provider with the scope of work, price, deposit and deadline.
§ 2 Services
- The Provider offers:
- building a Site in one of the Packages (one-time payment);
- monthly support for the Site: “Support” or “Support Plus” (subscription);
- single changes to the Site without a subscription.
- The scope of each Package and support plan is described on the H1ky Websites site at the time of the order. The exact scope for the Client is set in the Order confirmation.
- The Pro Package is marked “Coming soon” and can’t be ordered until further notice.
- The price does not include:
- the domain and any paid hosting (the Client buys them in their own name from a provider of their choice; Cloudflare hosting is usually free);
- writing texts and taking photos (the Client provides them), unless the Order confirmation says otherwise;
- online shops, payments, logins and booking systems built from scratch.
§ 3 Ordering and the contract
- The Client sends a request to marketing@h1ky.com. The Provider replies with a proposed Package, price and deadline.
- The Provider sends the Order confirmation together with these terms and the model withdrawal form (on a durable medium, i.e. by email).
- The contract is concluded when the Client confirms the order by email and pays the deposit (§ 4). A support contract is concluded with the first subscription payment.
- To use the services you need internet access, a web browser and an email address.
- The Provider does not provide services to persons or companies under European Union sanctions, or to persons and companies from Russia and Belarus where EU sanctions rules forbid it.
§ 4 Prices and payments
- Prices on the H1ky Websites site are net prices and are indicative (“from”). The Client gets the final price, including the gross amount, in the Order confirmation, before the contract is concluded and before paying.
- VAT is added to the net price as the law requires: 23% for Clients in Poland and for all Consumers (private persons), including those outside the European Union. For Clients not charged Polish VAT (e.g. companies from other EU countries with a valid VAT-EU number, who account for the tax under the reverse charge, and companies from outside the EU), the net price is the final price.
- Prices are shown in złoty, euro and hryvnia. The Client pays in the currency given in the Order confirmation.
- Payments are handled by Stripe (card, BLIK, Przelewy24, Apple Pay, Google Pay). The Provider sends the Client a payment link.
- Before work starts, the Client pays a deposit (“zadatek” under Article 394 of the Polish Civil Code), in the amount given in the Order confirmation (no more than 30% of the price). The deposit counts towards the price.
- The Client pays the rest of the price after accepting the finished Site, before the domain is connected and the Site is handed over.
- If the Client does not pay the rest of the price within 14 days of being told the Site is ready, the Provider may set an extra 7-day deadline and then withdraw from the contract. The Provider then keeps the deposit.
- Support is paid in advance every month, automatically, with the card saved in Stripe.
- The Provider issues an invoice for every payment and sends it by email.
- The deposit rules do not limit the withdrawal right of Consumers and Sole traders with consumer rights (§ 7).
§ 5 Building the Site
- The deadline (Start: 3 days, Standard: 1 week, Pro: 2 weeks, or another one given in the Order confirmation) counts from the day the Provider has received the deposit and all materials from the Client (texts, photos, logo, contact details).
- The Client sees the progress at a test address. The Client’s domain is connected only after the full price is paid.
- The Package price includes the number of rounds of changes given in the Package description (Start: 2, Standard: 3, Pro: 4). Further changes are paid at the single-change price.
- After launch, the Provider fixes errors for free during the period given in the Package description (Start: 7 days, Standard: 14 days, Pro: 30 days).
- The Client confirms they have the rights to the materials they provide (texts, photos, logo) and that using them does not infringe anyone else’s rights.
- Once the full price is paid, the Provider transfers to the Client the economic copyrights to the Site’s design and code, for: recording and copying by any technique, including digital; storing in computer memory and networks; making available to the public on the internet; modifying and creating adaptations. The Provider also allows the exercise of derivative rights.
- Third-party elements (e.g. fonts, code libraries, stock photos) are used under their authors’ licences.
- The Provider may show the Site in their portfolio unless the Client objects (an email is enough).
§ 6 Support (subscription)
- Support lasts one month and renews automatically every month until cancelled.
- Change limits and reply times are given in the plan description on the H1ky Websites site. Unused changes don’t carry over to the next month.
- The Client can cancel support at any time, in the Stripe customer portal or by email to marketing@h1ky.com. Cancellation takes effect at the end of the paid month.
- The Provider announces any change in the support price by email at least 30 days in advance. A Client who doesn’t agree can cancel before the change.
§ 7 Right of withdrawal
- Consumers and Sole traders with consumer rights can withdraw from the contract within 14 days of concluding it, without giving a reason.
- It’s enough to send a statement, e.g. by email to marketing@h1ky.com. You can use the model form at the end of these terms, but you don’t have to.
- The Provider refunds payments within 14 days of receiving the statement, using the same payment method, unless the Client agrees to another one.
- If the Client expressly asks for work to start before the 14 days are over (e.g. in reply to the Order confirmation) and then withdraws, they pay for the work done up to the withdrawal, in proportion to its scope.
- The right of withdrawal does not apply if the Provider has fully performed the service with the Client’s express consent, and the Client was told before work started that they would lose the right of withdrawal once the service is performed, and acknowledged this.
§ 8 Complaints
- Towards Consumers and Sole traders with consumer rights, the Provider is liable for the Site and services being in line with the contract, under the Polish Consumer Rights Act.
- Complaints can be sent by email to marketing@h1ky.com. Please describe the problem and say what you expect.
- The Provider replies to complaints within 14 days. If a Consumer gets no reply in that time, the complaint is considered accepted.
- Towards Clients who are neither Consumers nor Sole traders with consumer rights, statutory warranty (rękojmia) is excluded, and the Provider’s liability is limited to the price paid and does not cover lost profits.
§ 9 Liability
- The Provider is not liable for third-party services the Site uses (e.g. the domain registrar, Cloudflare, Stripe, outside widgets), or for content provided by the Client.
- This section does not limit the statutory rights of Consumers and Sole traders with consumer rights.
§ 10 Personal data
- How personal data is processed is explained in the Privacy policy on the H1ky Websites site.
§ 11 Disputes
- Consumers can use out-of-court ways to settle disputes, e.g. the help of a municipal or district consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa). More information: uokik.gov.pl.
- Disputes with Clients who are neither Consumers nor Sole traders with consumer rights are settled by the court competent for the Provider’s place of business.
§ 12 Final provisions
- Polish law applies to the contracts. This choice of law does not take away from a Consumer the protection given by the law of the country where they usually live, if that law is more favourable to them.
- These terms are available in Polish, English, Ukrainian and Russian. The Polish version is binding.
- The Provider may change these terms for important reasons (e.g. a change in the law or in the services). Changes do not apply to contracts concluded earlier; Clients with active support are told by email at least 14 days in advance.
- These terms are in force from 2026-10-28.
